End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User") and PinPoint Connect ("Company", "we", "our", or "us") governing your use of the PinPoint Connect mobile application and related services (the "App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to these terms, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this EULA, PinPoint Connect grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on a device that you own or control
  • Use the App for your personal, non-commercial purposes
  • Access the features and functionality of the App as intended

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise exploit the App or its content for any commercial purpose.

3. Restrictions

You agree not to, and will not permit others to:

  • Copy, modify, or distribute the App or any portion thereof
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to any portion of the App or its related systems
  • Use automated scripts, bots, or other tools to interact with the App
  • Upload or transmit any viruses or other malicious code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. Intellectual Property

The App and all content, features, and functionality thereof — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are owned by PinPoint Connect or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Nothing in this EULA transfers any intellectual property rights to you. You are granted only the limited license set out in Section 2 above.

5. User Content

You retain ownership of any content you submit, post, or display through the App ("User Content"). By submitting User Content, you grant PinPoint Connect a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the App.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe any third-party rights or violate any applicable laws.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this EULA by reference. By using the App, you consent to the data practices described in the Privacy Policy.

7. Updates and Modifications

PinPoint Connect may, at its sole discretion, update, modify, or discontinue the App or any part thereof at any time without notice. We may also update this EULA from time to time. Continued use of the App after any changes constitutes your acceptance of the revised EULA.

We encourage you to review this EULA periodically to stay informed of any updates.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PinPoint Connect does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PINPOINT CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Any content or conduct of any third party on the App
  • Any other matter relating to the App

10. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

PinPoint Connect may also terminate or suspend your access to the App at any time, with or without cause or notice, at its sole discretion.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts of England and Wales.
